This is an agreement between you and [Seller legal name] (“we”, “us”) about your use of Puffin Proxy (the “Software”). By installing or using the Software you agree to it. If you do not agree, do not install or use it.

1. What you get

When you buy a license, we grant you a non-exclusive, non-transferable, perpetual license to install and use the Software, subject to these terms.

• One license is for one person. That person may use the Software on any number of Macs they personally use, at home and at work.
• Personal and commercial use are both allowed. You may use the Software in your job, for clients and for your own business.
• Teams buy one license per person who uses the Software. A license may not be shared between people, and a shared or build machine used by several people needs a license for each of them.
• If you bought licenses for others (for example, your employer bought them for staff), the organisation may move a license from one person to another when someone leaves, no more than once every 90 days.

2. Trial use

If the Software offers a trial, you may use it during the trial without a license, only to evaluate it. When the trial ends, keep using it only if you buy a license.

3. What you may not do

You may not:

• share, sell, rent, lend or publish your license key, or use a key that was not issued to you;
• copy or distribute the Software, except for backups and installing it on Macs you are licensed to use;
• remove, bypass or disable the license check or any other technical protection;
• decompile, disassemble or reverse engineer the Software, except where the law allows it despite this restriction (for example, for interoperability);
• use the Software to intercept traffic that you are not authorised to inspect. You are responsible for having permission to inspect any network traffic you capture.

4. Updates

• Your license includes every update to version 1 of the Software (1.x), at no extra cost, for as long as we release them.
• A future major version (2.0 and later) may be a paid upgrade. If it is, your version 1 license keeps working with version 1 forever.
• We may change, add or remove features in updates. Installing updates is up to you.

5. Refunds

If you are not happy with the Software, ask for a refund within 30 days of purchase and you get your money back in full. When a purchase is refunded, its license ends and you must stop using the Software. This does not limit any refund rights you have under the law where you live.

Orders are processed by our reseller, [Payment provider], who is the merchant of record and handles payment, receipts, tax and refunds. Their buyer terms also apply to your purchase.

6. Your data

The Software has no telemetry. Captured traffic, certificates and settings stay on your Mac. Checking your license key does not send anything to us. Checking for updates downloads a file from our server. Like any web request, that request carries your IP address and the app’s version, and nothing else about you or how you use the Software. 7. Ownership

The Software is licensed, not sold. We, and our licensors, keep all rights, title and interest in the Software, including copyright and trademarks. Open-source components included in the Software are licensed under their own terms, which are listed in the Software. Nothing in this agreement limits your rights under those terms.

8. Ending the license

This license lasts until it ends. It ends automatically if you break these terms or if your purchase is refunded or charged back. When it ends, you must stop using the Software and delete your copies.

9. No warranty

The Software is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Software will be error-free, that it will work with every app or network, or that it will never interrupt your network traffic.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, or business, arising from your use of or inability to use the Software. Our total liability for any claim under this agreement is limited to the amount you paid for the license.

Some places do not allow these exclusions or limits, so some of them may not apply to you. Nothing in this agreement excludes liability that cannot be excluded by law.

11. General

• Law. This agreement is governed by the laws of [jurisdiction], without regard to its conflict-of-laws rules. This does not take away mandatory consumer protections of the country where you live.
• Export. You may not use or export the Software in breach of applicable export or sanctions laws.
• Changes. We may update these terms for future versions. The terms that came with the version you are using apply to that version.
• Whole agreement. This is the entire agreement between you and us about the Software. If any part is found unenforceable, the rest stays in effect. If we do not enforce a term, we have not waived it.
